An Oakland County judge has granted a preliminary injunction blocking enforcement of Michigan’s 1931 law which bans abortion access while a lawsuit moves through the courts. Judge Jacob Cunningham granted the injunction requested by Michigan Governor Gretchen Whitmer.

“This court finds it is overwhelmingly in the public’s interests to let the people of the great state of Michigan decide this matter at the ballot box, assuming the constitutional amendment initiative is on the ballot on November 8,” Cunningham said. “Therefore and for all these reasons, the court grants a preliminary injunction in this case.”

An appeal is likely. Still to come, the question of the constitutionality of Michigan’s 1931 law banning abortion which is still before the state’s Supreme Court, and later this month, the Board of State Canvassers will decide if the signatures gathered can get the question of a constitutional amendment before voters in November.
