State’s Debt Collection Releases New Report

A new report has been issued by the Debt Collection Work Group, a committee formed to ensure that debt collections can be more effectively navigated through the courts and, when appropriate, address debt collection cases without the assistance of an attorney. Katie Hennessy, co-chair of the committee, says debt collections can be complicated with debt-buyer cases on the rise.

“Many times, debt collection litigation is not brought by the original creditor. Instead, the creditor may choose to sell the debt to a debt buyer and these debts can be bought and sold several times over. Debt buyer cases present unique access to justice barriers, because consumers are being sued by a company that they may have never heard of before.”

Hennessy says based on report findings, the Debt Collection Work Group highly recommends creating court documents and forms that consumers can easily understand and use, which they say will improve everyone’s understanding of debt collection in Michigan.
